http://www.sulvaranpeterson.com/publications/europees-hof-onderzoekt-inhumane-detentieomstandigheden-op-sint-maarten

http://www.sulvaranpeterson.com/publications/europees-hof-onderzoekt-inhumane-detentieomstandigheden-op-sint-maarten#comments

Eldon "Peppie" Sulvaran

Paula Janssen

S&P Attorneys At Law

Op 13 december 2016 is cliënt, Francesco Corallo, op last van de procureur-generaal in Sint Maarten voorlopig aangehouden op aanvrage van Italië vanwege verzoek om zijn uitlevering. During a preliminary hearing before Judges of First Instance at the Courthouse on Friday, St. Dominic and Penijn as best speaker argued their way to an international moot court before the International Criminal Court in January 2018. Other participating schools were Caribbean International Academy (CIA), St. Maarten Academy (SMA) and Milton Peters College.

Head-to-head

During the court session, which was witnessed by Minister of Finance Richard Gibson, Minister of Education Silveria Jacobs and Members of Parliament Sarah Wescot-Williams, Perry Geerlings and Rodolphe Samuel, the three-member school teams went head-to-head as the defence and prosecution in mock proceedings in a case involving war crimes and weaponry.

Students argued their sides of the case based on international criminal law as applied by the International Court of Justice seated in The Hague. The pleadings were in English, as they will be in the international competition. The panel, comprising five judges, was presided over by St. Maarten Judge Katja Mans.

The winning team, which consists of students Yvette Rosario, Ajay Dayalani, Emmanuel Iman and substitutes Gayani Makhijani and Tan Arrindell, was advised by attorneys Shaira Bommel and Daniella Engelhardt. Together with best speaker Briani Penijn of MPC, they will head to the Peace Palace in The Hague next year, where they will argue a case in front of judges of the International Court of Justice and other international tribunals located in that city in next year's High School International Moot Court.

There the St. Maarten team will compete against teams from some 18 countries, which in the past have included the United States, Russia, China, Germany, Argentina, Bulgaria, Georgia, South Africa and Sweden, among others.

Life-changing

Students had two months’ time to prepare their cases. They were assisted and advised by St. Maarten-based attorneys and other legal experts.

“I’ve always been interested in law and wondered what it would be like to compete on a case. It’s been stressful, but good overall. It’s a lot of pressure, because we all want to win,” said Destiny Jagtiani (17) of CIA.

SMA selected its students by giving all applicants a mini-case, of which they had to give a short presentation.
“Students were picked based on their performance,” said Vincia Nelson (17). “We had lots of meetings. It was so much fun working with real lawyers. They were so supportive and kind. Working with them made me look at this as an experience rather than a competition.”

Raquel Chayadi (17) of MPC really enjoyed the preparation. “I thought it would be really serious and hard to do because as a teenager you very rarely come into contact with the law. However, our coach made it fun. Coming here, I think even if we don’t win, I am grateful to get to have this experience,” she said.

The Moot Court may have been a life-changing experience for Gayatri Malchijani (18) of St. Dominic, who said, “I would recommend this for younger students because it exposes you earlier to possible jobs. I really want to go into the medical field but this competition made me see that maybe the legal field would be something for me.”

Motivation and flair

The panel of judges praised the high level of all competitors during the prize-giving ceremony at Holland House Beach Hotel and said they had seen “incredible enthusiasm, motivation and flair.”

“This case was so incredibly difficult. In real life, only the finest of the finest present these cases and here you are, students, presenting so well and showing us how hard you worked,” Judge Mans said.

In describing the different teams, Mans said the CIA team “never gave up and had a remarkably strong rebound.” MPC was praised for “its strong rebound and pleading structure” and St. Dominic was praised for its exceptionally good speakers. The SMA team stood out for their “liveliness” and for “engaging and keeping the attention of the judges.” MPC 2 was described as “eloquent” and had responded well to their opponents and to questions by judges, said Mans.

Funding is available to send three students to The Hague, but considering that delegations may consist of as many as eight students, the SXM Moot Court Foundation calls on sponsors to make it possible to send five more “eloquent winners” to the Netherlands.

Source: The Daily Herald

Ontwerp landsverordening evaluatie consensusrijkswetten Curaçao 2018

http://www.sulvaranpeterson.com/publications/ontwerp-landsverordening-evaluatie-consensusrijkswetten-curacao-2018

http://www.sulvaranpeterson.com/publications/ontwerp-landsverordening-evaluatie-consensusrijkswetten-curacao-2018#comments

S&P Attorneys At Law

Medical cost for referrals to a medical specialist are to be covered, similar to basic health care.

Besides, the Court ordered that lawyers be given access to their clients on Thursdays. They are to announce their visit one hour ahead of time.

The findings of the European Committee for the Prevention of Torture, the response to these findings by Country St. Maarten, and the most recent report of the Law Enforcement Council, have played an important role in the Court’s decision.

Signals of major concern

These documents show that for the past 10 years signals of major concern about the situation in Pointe Blanche Prison have been given, and that Country St. Maarten did not keep its repeated promises to follow up on recommendations given, the Court said.

Denied, for various reasons, were the inmates’ claims pertaining to the suspension of Prison Director Edward Rohan, the holding cells at the Police Station, cell searches, two inmates in one cell, the separation of inmates, labour for women, and a 10 per cent reduction of prison time due to the inhumane situation in prison.

Most of these claims could not be awarded as these are closely connected with the overcrowded and outdated prison building. Only renovation and an extension of the current prison facilities would allow for measures to be taken to get rid of the bottlenecks in these areas.

According to Country St. Maarten, represented in the injunction by attorney-at-law Aernout Kraaijeveld, it should be left up to the Minister of Justice and the Prison’s new management team to come up with an action plan to adequately address the current “crisis” in the prison.

It is up to the Minister of Justice to set priorities without outside pressure. The Court should not take over the role of the executive branch. Many of the claims that were put forward are “unrealistic” and “too broadly formulated,” Country St. Maarten argued during the Court hearings of February 28, and of March 17.

The Court stated in its ruling that it agrees that it is not the Court’s job to manage the Prison. However, it was considered possible to demand certain measures in the injunction, due to the urgent circumstances of the case, and in taking into consideration all interests involved.

Period of normalization

“In this case, the Court had to evaluate if the situation in the Prison is so urgent and so far removed from being in accordance with the law that provisions aimed to end the unlawfulness need to be put in place. The Court to that effect carefully weighed all interests at stake and also paid attention to the degree at which the provisions can actually be executed. Furthermore, the Court has taken into consideration the “period of normalization” of three months that was repeatedly mentioned by Country St. Maarten,” the Court said.

In this light, the Court granted Country St. Maarten three months’ time to take measures, pertaining to, for instance, the prison guard workforce, shifts and training, as well as the education of young delinquents. Detainees 24 years and older should be provided with education within nine months from now.

The stipulations concerning the public phone, washing machine, a laundry room, library books, a prison dentist and lawyer visits on Thursdays also need to be implemented within three months’ time.

Detainees due for release need to be informed in writing no later than one month prior to their release date, the Court stated in the verdict. To this effect, Prison Director Edward Rohan has temporarily stepped down.
A taskforce, consisting of the Acting Secretary General of Justice, the Chief Prosecutor, the Chief of Police and the Secretary of the Court of Guardianship will be providing advice to the managers and the Minister of Justice concerning improvements, in conjunction with the Plan of Approach, the Action Plan of April 2016, and the recommendations of the Law Enforcement Council.

Without making any commitments to data and deadlines, Kraaijeveld said that containers with a detection gate, and beds, chairs, and sportswear, had arrived at the prison. A new, financially sustainable maintenance plan for 2018 should be ready by April 15. Construction of a fence is set to start on June 16, and locks are expected to be installed by July 31.

The Inmates Association and their lawyers were disappointed with the Ministry’s plans. “Something has been put on paper, but nothing specific,” attorney Sjamira Roseburg said. “This is nothing but a general plan presented to the Court and the media to show that Country St. Maarten is working very hard, but nothing has happened,” she said.
Stating that recently another inmate was attacked in his cell, the lawyer said that the prison cannot wait for a three-month normalisation plan. “I see no concrete plans and steps to improve safety. The situation is still the same. No extra security measures have been taken. The plans look nice on paper but nothing changes in practice,” Roseburg said.

“I heard nothing about detectors, training of guards, recreation and education for inmates, and visiting hours for lawyers. We seem to be floating apart instead of coming together,” Roseburg said in calling for concrete plans and a ruling in this case.

The Ministry admitted that not all of the inmates’ grievances were included in the plans, as the Ministry has to set priorities. “I hear a lot of criticism, but little understanding for the position of the Ministry,” said Kraaijeveld.
“Asking for understanding from detainees may be too much to ask, considering that they are very concerned about their safety and security,” the Judge said in response.

“We want answers to our questions, or Court decisions on these matters,” said Roseburg. The Court will give its decision in two weeks’ time.
