PHILIPSBURG--The Judge in the Court of First Instance on Friday ordered Country St. Maarten to take a number of measures to improve safety and security of inmates and guards at Point Blanche prison.

Represented by attorneys Sjamira Roseburg and Shaira Bommel, Point Blanche Inmates Association (PBIA) had filed an injunction in which it argued that the prison situation is very unsafe and the circumstances so poor that intervention by the Court is needed.

​​According to the inmates, it is urgently warranted that security measures be put in place, and that facilities and daytime activities are improved, that medical care is more widely made available, and that lawyers’ access to their clients be improved.

15 claims

To this effect, the Inmates Association filed 15 claims in total. The Court awarded eight of these claims, and attached daily fines of US $800 to each of these claims, in case of non-compliance, to a maximum of $50,000.

The Court’s evaluation of all facts and circumstances led to a number of provisions. Prison-guard shifts are to be executed by at least six prison guards in total, and shifts are not to last longer than eight hours per day. Prison guards are to receive professional training in first aid, emergency response, communication and motivation.

PHILIPSBURG--The Judge in the Court of First Instance will give its decision in the injunction filed by Pointe Blanche Inmates Association (PBIA) against country St. Maarten concerning safety and security concerns and a number of other issues in prison on March 31, it was announced on Friday.

PBIA, with lawyers Sjamira Roseburg and Shaira Bommel as their legal representatives, took Government to Court last month because the safety of prison inmates cannot be guaranteed and the living conditions are considered terrible.

Court acquits suspect in 2011 rip-deal case

PHILIPSBURG--The Joint Court of Justice on Wednesday acquitted 25-year-old Romaine Walters of involvement in the shooting and killing of L. Cuevas (41) during a violent robbery on Boxing Day, December 26, 2011.

The Court of First Instance held Walters for the killer and sentenced him to 11 years and six months, but he appealed the verdict of June 18. On that same date, co-defendant Bryan G. Henson (31) was sentenced in absentia to 27 months.

The Dominicano man was shot dead outside his home on Welfare Road in an alley in the vicinity of Ace hardware store. He sustained shots in his abdomen, collapsed face down and died on the spot in what is believed to have been a rip-deal involving money and coc

New lawyer Sulvaran & Peterson Sint Maarten

PHILIPSBURG - Law firm Sulvaran & Peterson recently added a third lawyer to their Sint Maarten office with Sjamira Roseburg.
 
Sjamira began studying law in 2009 at the University of Leiden. Later she studied law at the Connecticut School of Law in the United States and obtained her master’s degree from the Erasmus University (Rotterdam) in 2013 with a specialization in criminal law.

During her studies Sjamira worked as a legal assistant at the law firm Roethof in Amsterdam. She also volunteered at the children’s and youth legal information desk in Leiden, where she gave legal aid to youths in juvenile detention.
